Collecting, Processing and Using Personally Identifiable Information
Personally identifiable information (“PII”) is information which can be used to establish your identity. This includes information such as your name, address, postal address, e-mail address, and birthdate. We collect, process and use your PII when you register to create an account or update your account on the Site, subscribe for a newsletter, provide us with this data in order to execute your first order and any future orders on mambaby.com, or have received your PII from our affiliates or promotional partners having a right to share such data with us, as well as to advertise, market and promote the Company’s products and services to you.
We also use the postal and e-mail addresses you give us to communicate with you about your orders, to update our data records and to maintain your customer accounts with us.
Newsletter Consent, Additional Details Provided Voluntarily and Revocation
We process and use your e-mail address to provide information about similar products, pregnancy and/or development calendars only if you have consented to this on our Site by checking on the applicable box(es) when registering to create an account, or when updating your existing account, on the Site. Provided that you have subscribed to our Newsletter, we will also process and use the additional details you provide to us voluntarily about your pregnancy and the gender of your child(ren) in order, where appropriate, to send you product recommendations by e-mail from our MAM Online Shop at the Site which are tailored to your personal circumstances inferred from the information you have provided.
How We Share Your Personally Identifiable Information
• Subsidiaries and Affiliates. We may share your PII collected on this Site with our subsidiaries or affiliated companies, including those located in other countries.
• Third Party Service Providers. We share your PII with our service and partner companies as necessary for the purpose of order processing, customer services, managing and fulfilling orders made through the Site, to monitor and analyze Site activity, and otherwise to operate and maintain the Site. These companies may only use your PII for this purpose and they are also obliged to comply with all applicable provisions on data privacy.
• Legal Process. We also may disclose PII about you as required by law, in response to legal process including law enforcement requests, and where needed to protect the safety, property, or legal rights of users of the Site, the Company or its affiliates or third parties.
Statutory law may require us to disclose your details to third parties. We only meet such demands within the framework of the statutory obligation and following careful examination of whether such an obligation does in fact exist.
You can opt-out from receiving any future editions of our Newsletter at any time by clicking the “unsubscribe” link provided in each e-mailed Newsletter or by sending an email message to email@example.com or to MAM USA Corporation, 2700 Westchester Avenue, Suite 315, Purchase, NY 10577, Phone: 1 (866) 949-1174.
Right of Objection
You can also object to your PII being processed and used to execute future orders simply by sending a message to one of our addresses given above. We will then block your PII for further use promptly after receiving your request and delete this data as soon as the storage periods under fiscal and commercial law have expired, but we wish to point out that this will mean we will have to collect all the necessary data again when you place another order with us.
We have implemented commercially reasonable measures designed to secure your PII from accidental loss and from unauthorized access, use, alteration and disclosure. For example, when you create an account on the Site or provide any order information, we use Secure Socket Layer (SSL) technology, an encryption tool that provides security while transmitting this information over the Internet. Although we have implemented the above security measures for this Site, you should be aware that 100% security is not possible. Therefore, the provision of such information is done at your own risk and, to the greatest extent permitted under applicable law, we shall have no liability for disclosure of your PII due to any error, omission or unauthorized act of the Company or any third party during or after transmission.
We take reasonable steps to verify your identity before granting you account access, however, you are solely responsible for maintaining the secrecy of your unique username, password and account information at all times.
In the event we believe that the security of your PII in our possession or control was or may have been compromised, we will notify you of that development if required by applicable law or in our discretion using any of the methods prescribed thereunder (by providing us with your email address, you hereby consent to receiving any such notification in electronic form through such email address).
This Site uses Google Analytics, a web analysis service of Google, Inc. ("Google"). Google Analytics uses "cookies", which are text files stored on your computer, to analyze how you use the Site. The information generated by the cookie about your use of this Site (including your IP address) is sent to a Google server in the U.S. and stored there. Google will use this information to evaluate your use of the Site, compile reports on website activity for the website operators and to provide other website activity related internet services. Additionally, Google may transfer this information to a third party when required by law or in the case of a third-party processing information on Google's behalf. In no case will Google use your IP Address in connection with any other information held by Google. You can set your internet browser to prohibit the installation of cookies, although we must point out that some features and functions of the Site will then be unusable. By using this Site, you consent to the processing of data about you collected by Google in the manner described and for the above mentioned purpose. The consent for collection and storage of data can be withdrawn at any time in the future by clicking on the following link: tools.google.com/dlpage/gaoptout. Given the debate concerning the use of analytical tools using full IP addresses, we wish to point out that this Site uses the "Anonomize IP" function of Google Analytics which works with a shortened form of IP addresses to avoid direct personal identification.
In order to be able to place an order in the MAM Online Shop on the Site, the security settings on your browser need to permit so-called cookies to be written to your computer. Cookies are small data records which are saved from our Site to your hard disk and allow your computer to be recognised when you next visit our Site.
We require this function to be able to provide a better service and temporarily store products in your shopping cart for you for 24 hours. Furthermore, we use the cookies to carry out frequency assessments, page usage assessments and marketing assessments. For the aforementioned assessments, we utilize this cookie information without a link to your PII, so it is completely anonymous.
We may employ cookies and action tags (also known as single pixel gifs or web beacons) to collect information about your use of, and activities on, the Site for our use and for use by third parties that serve advertisements about the Company’s products or services to you on other websites you may visit. The information collected from cookies also allows us to provide a more personalized experience for you on the Site.
You can set your Internet browser up so that you are notified when cookies are stored, you can decide in each individual case whether you want to accept cookies, or you can refuse to accept any cookies. However, if you do not accept cookies, you may be restricted in how you are able to use our Site. You can delete cookies which are already stored on your hard disk at any time. You will find more details on how to do this in the operating guide for your Internet browser program.
Targeted Ads on Facebook
We may use web pixels or other technology to serve ads to you on Facebook that we believe will be of interest based on your visits to the Site or the U.S. Site. If you wish to adjust how we (and other website operators) serve ads to you based on your off of Facebook activity, please visit Facebook’s Help Center, follow the “Manage Your Account” button under the “Desktop Help” tab, then follow the “About Facebook Ads” button, and click the “How can I adjust how ads are targeted to me based on my activity off of Facebook?” button to expand the content.
We do not knowingly request or collect PII online from any person under the age of thirteen. In the event we learn we have collected PII from a child under age thirteen, we will delete that information.
Access to Your PII
In accordance with the regulations of the German Data Protection Act, you are entitled to receive information about the data stored on you free of charge and if you wish you may demand that this data be corrected, blocked or deleted.

Pursuant to Section 1798.83 of the California Civil Code, residents of California have the right to request from a business, with whom the California resident has an established business relationship, certain information with respect to the types of personal information the business shares with third parties for direct marketing purposes by such third party and the identities of the third parties with whom the business has shared such information during the immediately preceding calendar year.
